General Terms & Conditions

§1 Validity vis-à-vis entrepreneurs and definitions of terms

(1) The following General Terms and Conditions shall apply according to German Law to all deliveries between Helen Shulkin and a customer in the version valid at the time of the order.

A customer is any natural person who concludes a legal transaction for purposes which cannot predominantly be attributed to either his commercial or his self-employed professional activity (§ 13 BGB).

§2 Conclusion of a contract, storage of the contract text

(1) The following provisions on the conclusion of a contract apply to orders placed via Helen Shulkin’s Home Page. The order is placed by a contact request: https://helenshulkin.com/contact

(3) The presentation of original artworks on Helen Shulkin's Home Page does not constitute a legally binding offer of contract on her part, but is merely a non-binding invitation to the customer to order original artworks by contacting her by https://helenshulkin.com/contact.

(4) The Customer acknowledges and agrees that Helen Shulkin uses commercially reasonable efforts to display the colors of the Original Artworks via the Home Page. However, as individual computer monitors may display colors differently, Helen Shulkin is not responsible for the color accuracy of Original Artworks displayed on the Home Page and disclaims any liability in this regard.

(5) All Original Works of Art of Helen Shulkin are selling as UNFRAMED Original Works of Art. All Original Works are signed by Helen Shulkin.

(6) The following provisions apply to the receipt of an order on Helen Shulkin's Home Page: The customer makes a binding offer to enter into a contract by successfully completing the ordering process:

1) Non-binding contact request: https://helenshulkin.com/contact.
2) Naming the work and asking for the price and availability of the work.
3) Negotiation process: the client is allowed to give his price proposal.
4) Helen Shulkin and the client agree on the price for the work.
5) The client gives his address where the work is to be delivered to
6) Helen Shulkin issues an invoice
7) The client pays the invoice
8) After the money is paid, the work is packed and shipped.

(7) The customer pays the postal, packaging and printing costs. Helen Shulkin will provide all invoices on request.

(8) Storage of the contract text with orders: Helen Shulkin sends you the invoice and her Terms & Conditions by E-Mail. You can also view the general terms and conditions at any time at https://helenshulkin.com/terms-conditions. For security reasons, your order data is no longer accessible via the Internet.

§3 Prices, shipping costs, payment, due date

(1) Helen Shulkin is a small business in accordance with § 19 Abs. 1 Sentence 2 of the German Turnover Tax Act and therefore does not charge VAT.

(2) The customer has the possibility of payment by PayPal: contact@helenshulkin.com or can transfer the money to the banking account given in the invoice.

§4 Delivery

(1) Unless Helen Shulkin has clearly stated otherwise, all items offered by Helen Shulkin are immediately ready for dispatch. The delivery takes place here at the latest within 14 working days. In case of payment in advance, the delivery period begins on the day following the payment order to the bank commissioned with the transfer and, in case of all other payment methods, on the day following the conclusion of the contract. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline shall end on the next working day.

(2) The risk of accidental loss and accidental deterioration of the goods sold shall not pass to the Buyer until the goods are handed over to the Buyer, even in the case of sale by delivery to destination.

§5 Retention of title

(1) Helen Shulkin reserves title to the goods until the purchase price has been paid in full.

§6 Right of withdrawal of the customer as a customer:

(1) Customers are entitled to a right of revocation in accordance with the following provision, whereby a consumer is any natural person who concludes a legal transaction for purposes which can predominantly be attributed neither to his commercial nor his self-employed professional activity.

(2) You have the right to revoke this contract within fourteen days without giving reasons.

(3) The withdrawal period shall be 14 days from the date on which you or a third party other than the carrier designated by you took possession of the goods.

(4) In order to exercise your right of revocation, you must inform you by means of a clear statement by

of your decision to revoke this Agreement. You may refuse to do so by filling in the attached sample revocation form.

(5) If you withdraw from this contract, Helen Shulkin shall repay to you all payments that Helen Shulkin has received from you, including the delivery costs, except the additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by Helen Shulkin, without undue delay and at the latest within fourteen days from the day on which Helen Shulkin has received the notification of your withdrawal from this contract and the work has been returned. For this repayment, Helen Shulkin will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.

(6) Helen Shulkin may refuse to refund until Helen Shulkin has received the Goods back or until you have provided evidence that you have returned the Goods, whichever is earlier.

(7) You must return or hand over the goods to Helen Shulkin immediately and in any event within fourteen days of the day on which you notify Helen Shulkin of the revocation of this contract at the latest. This period shall be deemed to have been observed if you dispatch the goods before the expiry of the period of fourteen days.

(8) You shall bear the direct costs of returning the goods.
